PEAK PRO CLEANERS INC.
TERMS OF SERVICE AND USER LICENSE AGREEMENT
By accessing this website and/or booking an appointment through this website, you are agreeing to be bound to the following Terms and Conditions. These Terms and Conditions govern your use of this website and any services booked by you to be provided by Peak Pro Cleaners Inc. (“Peak Pro”). This is a legal agreement between you and Peak Pro.
- BOOKING OPTIONS AND POLICY
You can book appointments in the following ways: 1) You can book a single, non-recurring appointment; 2) you can book recurring weekly appointments; 3) you can book recurring bi-weekly appointments; and 4) you can book recurring monthly appointments.
Having a credit or debit card on file is required to book an appointment. Peak Pro will put a hold on the card three (3) days before the appointment. If the card has insufficient funds or is declined, Peak Pro will need a valid card for payment at least twenty-four (24) hours before service to avoid automatic service cancellation.
- Text Messaging Terms and Conditions
By providing your phone number to or booking services with Peak Pro Cleaners, you agree to receive SMS/text messages from us, including but not limited to appointment reminders, service updates, promotions, and important notifications. Please review the following terms and conditions:
Consent
By opting in, you authorize Peak Pro Cleaners to send text messages to the mobile number provided. Consent is not a condition of purchase, and you may opt out at any time.
Message Frequency
You may receive recurring text messages depending on your interactions with us, typically related to appointment scheduling, confirmations, service updates, and occasional promotional offers.
Message & Data Rates
Standard message and data rates may apply based on your mobile carrier plan. Check with your carrier for details.
Opting Out
To stop receiving text messages, reply “STOP” to any message you receive. You may also contact us directly at 303-335-0342. Once you opt out, you will no longer receive text messages from us unless you re-enroll.

Privacy
Your privacy is important to us. We will not sell or share your mobile number with third parties for their marketing purposes. Text messages are subject to our Privacy Policy, available at https://peakprocleaners.com/terms-conditions.
Liability
We are not responsible for delays or undelivered messages caused by factors outside of our control, such as carrier issues or service interruptions.
Changes to Terms
Peak Pro Cleaners reserves the right to modify these terms and conditions at any time. Changes will be posted to our website at https://peakprocleaners.com/terms-conditions.
- PAYMENT
Peak Pro does not accept cash or checks to pay for services. The card on file shall be automatically charged within twelve (12) hours after the cleaning services are completed. Should the card on file be declined after service or funds are insufficient, the client shall have fifteen (15) days to render payment in full. Any payment received after fifteen (15) days shall incur a late charge of $20 per day, up to, but not exceeding $600.00.
In the event you fail to pay Peak Pro as provided in this Section, you agree to pay, in addition to all amounts due, any and all costs and expenses incurred by Peak Pro in exercising its rights or remedies under these Terms and Conditions or in collecting money due under these Terms and Conditions, including but not limited to reasonable attorney’s fees, court costs, and collection agency fees.
- CANCELLATION POLICY
ALL CLEANING CANCELLATIONS
If you have booked a single, non-recurring, appointment with Peak Pro you shall give at least 24 hours’ notice to cancel or reschedule. If you fail to give such notice, you shall incur a $50 cancellation fee.
If you have booked recurring services, the following cancellation policies will apply:
- Weekly appointments: you can cancel two (2) times per quarter with no penalties (“Weekly Penalty Exception”). However, you shall incur a $50 cancellation fee for each cancellation in excess of the Weekly Penalty Exception. For purposes of this Terms of Service, the quarters of the year shall be dictated by the month in which you had your first appointment. For purposes of illustration, if you had your first weekly appointment in March, the 1st quarter shall be March through May; 2nd quarter shall be June through August; 3rd quarter shall be September through November; and fourth quarter shall be December through February.
- Bi-weekly appointments: you can cancel one (1) time per quarter with no penalties (“Bi-Weekly Penalty Exception). However, you shall incur a $50 cancellation fee for each cancellation in excess of the Bi-Weekly Penalty Exception.
- Monthly appointments: you can cancel two (2) times per year with no penalties (“Yearly Penalty Exception”). However, you shall incur a $50 cancellation fee for each cancellation in excess of the Yearly Penalty Exception. For purposes of the Yearly Penalty Exception, one year shall be calculated by starting with the month of the first appointment and then count the following eleven months from then on. For illustrative purposes, if you start your monthly appointments in March of 2025, then the year for purposes of the Yearly Penalty Exception shall run from March of 2025 through February of 2026.
For any appointment, should Peak Pro show up to the property and be unable to access the property to perform the services for the appointment, you shall be required to pay Peak Pro an amount equal to fifty percent (50%) of the service amount. Furthermore, if you cancel within three (3) hours of your scheduled cleaning time you shall also be required to pay Peak Pro an amount equal to fifty percent (50%) of the service amount
- CLUTTER POLICY
Clutter is a mass of trash, items, knick-knacks, or personal items on the countertops or floors of your home. Clutter significantly inhibits our ability to perform our tasks and stay on schedule. All clutter shall be removed from the property prior to Peak Pro arriving to perform the cleaning services.
Clutter can impede Peak Pro from performing the services to its fullest potential, and clutter can prevent Peak Pro from doing so because it can result in cleaning techs missing areas to be cleaned. Furthermore, there is a significantly higher chance of Peak Pro breaking something or misplacing your things.
Therefore, the following rules pertaining to clutter shall apply:
- If a room has enough clutter to cover the floor, Peak Pro will not be able to clean that room.
- If your countertops are covered in clutter, Peak Pro will clean around the clutter without moving items, if the clutter leaves nearly no visible countertop space, Peak Pro will skip this area.
- If half the rooms in your home are covered in clutter, Peak Pro will have to phone the office and get a manager involved. In most cases, this will result in rescheduling or cancelling your cleaning.
- Peak Pro cannot clean while someone moves clutter around for it, and Peak Pro cannot move excessive clutter ourselves.
- If Peak Pro has to leave your home due to clutter, you will be charged for the time Peak Pro was there plus the time it took to commute to your home. Peak Pro’s hourly rate, in this case, is $70 per labor hour, per person, in your home & commute. For example, if Peak Pro left due to clutter and had two (2) cleaners, and between the commute and labor hour that they were there for was two (2) hours each, you would be responsible for paying Peak Pro a total of $280.00.
- BIO-HAZARD & PET WASTE POLICY
If the cleaning techs are unable to do their jobs from noxious smells/fumes in the home Peak Pro will have to cancel your service. You will be charged according to our cancellation policy listed above.
BLOOD & OTHER BIO-HAZARD
As a cleaning company, Peak Pro’s team has no training for handling blood, needles, medicated items, drugs, or anything that could be considered a bio-hazard. The cleaning techs have been instructed to ignore areas that have these items and areas. If there is excessive bio-hazard in the home, Peak Pro cleaning techs will phone a manager. In most cases, this will result in a cancellation of the service and will be treated according to our cancellation policy.
PET DROPPINGS
If there is a random pet dropping on the floor, and it looks like it can be picked up with a piece of toilet paper, Peak Pro will pick it up and dispose of it in the garbage. If there are excessive pet droppings, or the droppings look as if they cannot be picked up with a single piece of toilet paper, Peak Pro will clean around it and leave a note on the checklist.
URINE
If a Peak Pro cleaning tech can smell or see urine/pet waste, Peak Pro will not use company equipment in this area. Urine and other pet waste smells can get stuck in Peak Pro equipment and ruin it.
- AGGRESSIVE ANIMALS
- Client Responsibility
- Clients must inform Peak Pro Cleaners during the booking process if there are pets in the home, particularly those that may exhibit aggressive behavior.
- It is the client’s responsibility to secure aggressive pets in a safe and confined space away from the cleaning area before the cleaning team arrives.
- Definition of Aggressive Behavior
- Aggressive behavior may include but is not limited to:
- Barking, growling, or lunging at cleaning team members.
- Biting, snapping, or scratching.
- Blocking access to areas of the home.
- Aggressive behavior may include but is not limited to:
- Securing Pets
- Aggressive pets must be secured in an enclosed area such as a separate room, kennel, or outdoor space for the duration of the cleaning appointment.
- If the pet is not secured upon arrival, our team reserves the right to delay or cancel the cleaning appointment until the pet is safely confined.
- Service Refusal and Cancellation
- If our team arrives at the home and encounters an aggressive pet that is not properly secured, we may refuse service.
- Cancellations or service refusals due to aggressive pets will be subject to our standard cancellation policy, which may include applicable fees.
- Incident Protocol
- If a team member feels threatened or is injured by a pet during a cleaning appointment, the service will be immediately paused, and the incident will be reported to the office.
- The client will be contacted, and the service may be terminated or rescheduled after ensuring the pet is properly secured.
- Liability Disclaimer
- Peak Pro Cleaners is not responsible for injuries to pets that may occur during cleaning as a result of their own behavior.
- Clients will be held liable for injuries to cleaning team members or damage to cleaning equipment caused by their aggressive pet.
- Exclusions
- Homes with pets that cannot be secured or controlled may not be eligible for our services.
- CLIMATE POLICY
Peak Pro is committed to providing a pleasant work experience for our staff, and that includes a certain comfort level of temperature while Peak Pro cleans your home. Therefore, you agree to abide by the following temperature requirements:
The temperature in your residence must be within the range of 75 degrees Fahrenheit and 65 degrees Fahrenheit. In no event shall the temperature be outside that range of temperature.
While in the home, if the temperatures do not meet the requirements as outlined in this Section, Peak Pro shall adjust the thermostat during the time it is in the home. Should you refuse to allow Peak Pro to adjust the thermostat as stated in this Section or abide by the temperature ranges as stated above, Peak Pro shall cancel your cleaning, and you will be subject to our cancellation policy as stated above.
- EQUIPMENT POLICY
Peak Pro shall label all equipment, vacuums, chemicals, supplies, tools, protective gear, sprays, disposable items, and anything else that can be considered as a cleaning supply as “Supplies.” Peak Pro shall only use its own Supplies, as it is warrantied, and its employees have been trained on how to use the Supplies. In no event shall Peak Pro use your cleaning materials or supplies unless specifically requested.
CLIENT-PROVIDED CLEANING PRODUCTS
- Client Product Requests
- Clients must inform us at the time of booking if they prefer our cleaners to use their own cleaning products.
- A detailed list of the products, along with their intended use (e.g., kitchen counters, floors, bathroom surfaces), should be provided in advance.
- Product Safety
- All client-provided products must have visible and legible labels, including usage instructions and safety warnings.
- We reserve the right to refuse the use of products that are unmarked, appear unsafe, or contain hazardous chemicals.
- Products requiring specialized training or equipment for safe usage will not be used.
- Effectiveness Disclaimer
- Peak Pro Cleaners ensures the highest quality standards when using our company-provided cleaning products.
- If client-provided products are used, Peak Pro Cleaners cannot guarantee the same results or accept responsibility for damage caused by the client’s products.
- Product Placement
- All client-provided products should be readily available in the areas they are to be used.
- Our cleaners are not responsible for locating or retrieving products from inaccessible locations.
- Additional Time
- Using unfamiliar products may require additional time for testing or adjustments. This may result in an extended cleaning duration.
- Allergies and Sensitivities
- Clients must disclose if their requested products are required due to allergies or sensitivities to our standard cleaning solutions.
- In such cases, we will take extra precautions to accommodate the client’s needs while ensuring the safety of our team members.
- Acknowledgment and Consent
- By requesting the use of their own products, clients acknowledge the terms outlined in this policy and agree to waive liability for any damage, reduced effectiveness, or unforeseen issues arising from the use of their products.
Exceptions
We reserve the right to decline requests to use client-provided products if they conflict with our company standards, safety protocols, or environmental policies.
- VALUABLES
You shall make every effort to remove valuable items, including, but not limited to, cash, checks, coins, cards, sentimental items, jewelry, and firearms. Peak Pro Cleaners will not touch these items and will do its best to clean around them.
- BEFORE & AFTER PHOTOS
At Peak Pro Cleaners, we are proud of the exceptional results we deliver and occasionally use before and after photos for marketing purposes. This policy outlines how we handle photos responsibly while respecting our clients’ privacy and maintaining confidentiality.
Purpose of Photos
Before and after photos are used to showcase the quality of our cleaning services and highlight the value we provide. These photos may be featured on our website, social media platforms, or other marketing materials.
Automatic Client Consent
By using our services, clients grant Peak Pro Cleaners permission to take before and after photos of cleaned areas for marketing purposes unless otherwise specified.
Guidelines for Photo Use
- Privacy Protection:
- Photos will only feature the cleaned spaces and will exclude any personal or identifiable items such as family photos, paperwork, or sensitive belongings.
- No confidential or identifying information about the client or their household will be included in any photos.
- Restricted Access:
- Photos will be taken solely in the areas cleaned by Peak Pro Cleaners.
- If you have specific restrictions or areas you do not want photographed, please inform us before your cleaning appointment.
- Usage and Storage:
- Photos will be securely stored and used exclusively for Peak Pro Cleaners’ marketing purposes.
- Photos will not be shared with third parties or used outside of promotional contexts without explicit client approval.
Opting Out
We understand that some clients may prefer not to have photos taken in their homes. If you do not wish for photos to be taken or used, please notify us at any time via [email address] or [phone number], and we will ensure your preference is respected.
Your trust is our priority, and we are committed to maintaining the privacy and comfort of your home while showcasing the exceptional quality of our work.
- DISCLAIMER OF LIABILITY
LIMITATION OF WARRANTIES AND LIABILITY:
BY USING THIS WEBSITE OR PURCHASING PEAK PRO SERVICE FROM ANY SOURCE YOU ARE AGREEING TO PEAK PRO’S TERMS OF LIABILITY.
THIS SERVICE IS PROVIDED ON AN “AS IS” BASIS, WITHOUT ANY OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABLE QUALITY, SATISFACTORY QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR THOSE ARISING BY LAW, STATUTE, USAGE OF TRADE, COURSE OF DEALING OR OTHERWISE. THIS LIMITATION APPLIES TO THE CLEANING SERVICE AS WELL AS TO ANY ADDITIONAL SERVICES USED TO PERFORM ANY REQUESTED TASKS. THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE SERVICE IS ASSUMED BY YOU. PEAK PRO SHALL NOT HAVE ANY LIABILITY TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, LOSS OF REVENUE OR PROFIT, LOST OR DAMAGED MATERIALS, PROPERTY, OR OTHER COMMERCIAL OR ECONOMIC LOSS, EVEN IF PEAK PRO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR THEY ARE FORESEEABLE. PEAK PRO IS ALSO NOT RESPONSIBLE FOR CLAIMS BY A THIRD PARTY. THE LIMITATIONS IN THIS SECTION SHALL APPLY WHETHER OR NOT THE ALLEGED BREACH OR DEFAULT IS A BREACH OF A FUNDAMENTAL CONDITION OR TERM OR A FUNDAMENTAL BREACH. IT SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY THE LAW OF ANY APPLICABLE JURISDICTION. THIS LIMITATION MAY NOT BE CHANGED EXCEPT BY A WRITING SIGNED BY THE US.
LIMITATION OF REMEDY: IN NO EVENT SHALL ANY DAMAGES AGAINST PEAK PRO BE RECOVERABLE IN EXCESS OF THE COST OF THE CLEANING ITSELF. NO PUNITIVE DAMAGES MAY BE RECOVERED AND PEAK PRO SHALL NOT BE LIABLE FOR THE COST OF PROCURING SUBSTITUTE SERVICES OR PRODUCTS. ANY ACTION BY THE CLIENT ALLEGING DAMAGES OF THIS AGREEMENT MUST BE COMMENCED WITHIN 48 BUSINESS HOURS FROM THE ALLEGED DAMAGE.
It is understood and agreed that Peak Pro shall not be liable for any damage of any kind that is not caused by the negligence of Peak Pro, its agents, representatives or employees. With regard to any claimed personal injury or property damage, Peak Pro will not be liable for any indirect, special, or consequential damages (including loss of profits) arising out of this agreement or the performance of the services provided by Peak Pro.
- USE LICENSE
Permission is granted to view the materials on Peak Pro’s website for personal, non-commercial transitory viewing only. You may not: modify or copy the materials; attempt to decompile or reverse engineer any software contained on Peak Pro’s website; transfer the materials to another person or “mirror’ the materials on any other server.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by Peak Pro at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
- GOVERNING LAW AND DISPUTE RESOLUTION.
These Terms and Conditions and your relationship with Peak Pro shall be governed exclusively by, and will be enforced, construed, and interpreted exclusively in accordance with, the laws applicable in the State of Colorado, without regard to its conflict of law provisions. All disputes under these Terms and Conditions will be resolved by the courts of Douglas County, Colorado, and you consent to the jurisdiction of and venue in such courts and waive any objection as to inconvenient forum. In any action or proceeding to enforce rights under these Terms and Conditions, the prevailing party shall be entitled to recover costs and legal fees.
- MISCELLANEOUS PROVISIONS.
- You acknowledge the risk that information transmitted electronically through the website may be intercepted by third parties. You agree to accept that risk and will not hold Peak Pro liable for any loss, damage, or injury resulting from the interception of information.
- The failure of either party to enforce any provision hereof shall not constitute or be construed as a waiver of such provision or of the right to enforce it at a later time.
- These Terms and Conditions constitute the entire agreement between you and Peak Pro, superseding any prior agreements between you and Peak Pro (including, but not limited to, any prior versions of this agreement).
- Peak Pro reserves the right to amend these Terms and Conditions. In the event of material changes to the Terms and Conditions, Peak Pro will notify you, by email, or by other reasonable means of these changes prior to their enactment. Continued use of Peak Pro services after reasonable notice will be considered acceptance of any new terms.
- Neither party may assign any of its rights or obligations hereunder, whether by operation of law or otherwise, without the prior written consent of the other party (which consent shall not be unreasonably withheld). Any attempt by a party to assign its rights or obligations under these Terms and Conditions in breach of this Section shall be void and of no effect.
- If any provisions of these Terms of Service shall be unlawful, void or for any reason unenforceable, then such provision shall be deemed severed from these Terms of Service and shall not affect the validity and enforceability of any remaining provisions.
- DISCLAIMER
Peak Pro does not warrant that any of the materials on its website are accurate, complete, or current. Peak Pro may make changes to the materials contained on its website at any time without notice. Peak Pro does not, however, make any commitment to update the materials.
Peak Pros may revise these terms of use for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these Terms and Conditions of Use.
- USE OF SUBCONTRACTORS
Peak Pros holds the right to use subcontractors to perform cleanings and tasks. All employees or contractors go through the same hiring process including, but not limited to, a criminal background check and an in-person interview. For the safety of you and our team, Peak Pro may require contractors to wear a uniform or name tag so that all parties are aware of who is entering residences and offices.
- PRIVACY POLICY
Before or at the time of collecting personal information, Peak Pro will identify the purposes for which information is being collected.
Peak Pro will collect and use of personal information solely with the objective of fulfilling those purposes specified by Peak Pro and for other compatible purposes, unless Peak Pro obtains the consent of the individual concerned or as required by law.
Peak Pro will only retain personal information as long as necessary for the fulfillment of those purposes.
Peak Pro will collect personal information by lawful and fair means and, where appropriate, with the knowledge or consent of the individual concerned.
Personal data should be relevant to the purposes for which it is to be used, and, to the extent necessary for those purposes, should be accurate, complete, and up-to-date.
Peak Pro will protect personal information by reasonable security safeguards against loss or theft, as well as unauthorized access, disclosure, copying, use or modification.
Peak Pro will make readily available to customers information about our policies and practices relating to the management of personal information.
Peak Pro is committed to conducting our business in accordance with these principles in order to ensure that the confidentiality of personal information is protected and maintained.
